Kate Snow reports on the adoption process in Utah and one father's struggle to get custody of the baby he never had the opportunity to meet. His daughter, who was born in Virginia, is now in the custody of a couple in Utah. Snow shares this father's story and the heartache of three others who have experienced the same loss.  A Father's Fight airs Friday, August 19th, at 9pm/8c.

Keith Morrison tells the story of Nancy Cooper who went missing in a suburb of Raleigh, North Carolina. Her husband said she went running that morning and strangers even claimed they saw a woman who fit Nancy's description. How did this go from a missing persons case to a homicide, and did Nancy really go running that morning? If Dateline uses only Nancy's firends and family to base this story on, then we know it is going to be full of gossip and speculation. I wonder if they'll all talk about how many infidelities Nancy had? I really wish that Dateline would have taken the time to actually WATCH part of this trail, then this story would have a totally different spin.

My thoughts exactly - it seems like they are parading these same witnesses, whose baseless lies, corroboration, and twisting of the truth to the Cary Police Dept started the whole railroad job on Brad Cooper.

Upon following up on all the neighbors and Nancy's friends heresay - and realizing the evidence just wasn't there pointing to Brad doing it - they fabricated a "smoking gun" by planting a google map search on Brads computer while in police possession. This was clearly shown to have occured in testimony by the USA's leading digital forensic expert - testimony that the biased Judge Gessner did not allow the jury to see.

I am stressing that Utah may not change. However, every other State can enact legislation to mandate all parties must agree to adopt. If not, the primary person that moves this child into the care of citizens in Utah, will be charged with a Felony. A felony of Kidnapping, and Abandonment by every State Law, where Dept. of Human Service will become involved, and any additional children any that are prosecuted will fall under the care of the State until a ruling is determine. This is also slavary, where without money but turning over a child to a family without the child permission and other parent can be construed as "slavery". We have no idea what will happen to this child, and if there was a medical emergency and a need for the other party, what happens then? We can change the law to discourage this practice immediately, it will take years with the Supreme Court! I pray God answers our prayers, and Utah and those that "sell" their child away our punish

    I hope you will cover the police, prosecutor and judicial misconduct of the trial. It is available for the world to see on WRAL. The entire trial is online.

    Cary police wiped two cell phones and destroyed a SIM card. The defense expert witness had never seen evidence destroyed in over a decade of working with electronic evidence. Cary police waited past the privacy policy to release the destroyed phone to the defense, so it would be too late for them to obtain the detailed records from AT&T.

    There is evidence of computer tampering and planted files, yet police and the FBI did nothing to rule out these allegations and they could have. 1) they could have subpoenaed Google for the cookie records which provide record of which computer was used to do the search and 2) they could have asked Cisco to verify it on their network. They did neither. That is extremely suspicious. Further, they again didn't turn over this evidence to the defense until THAT privacy policy lapsed too, so defense couldn't even request the cookie information from Google to help exonerate their client.

    The judge refused to allow testimony about the computer tampering into the trial. The jury never heard it and that is how he was found guilty on NO evidence.

    Aside from the computer evidence, the rest was gossip about Brad's affair and the $1200/month budget he put Nancy on. Not one of the "friends" testified that Brad ever so much as yelled at Nancy and she was not afraid of him.

    Jessica Adam's initial call to police followed by Bazemore's comments that this is not a random act of violence led to an immediate prosecution. Police ignored and destroyed evidence that could have cleared Brad Cooper.

    This was an enormous travesty of justice that must be revealed.

    Utah will not change. However, all other States can enact legislation to mandate those girls/females, males, guardians that removes a child to UTAH without both parties consent, should be charged with Kidnapping, Slavery, Abandonment, and I will assure you they will not continue to unethically deny the other party. Everyone that is involved should receive a Felony charge! And if it is considered abandonment, any additional children will come under the State guidance to determine if those that continue to do this, will have to turn their other kids over until a ruling can be made!

      Brad Cooper's trial was a travesty in the American judicial system. An innocent man was convicted to make the Cary Police Dept. and District Attorney's Office look good. It didn't matter who the killer actually was, they just wanted a conviction.

      A biased judge allowed countless witnesses to provide hearsay evidence, none of which, was substantiated. How can unsubstantiated gossip be introduced as evidence? An inept Police Dept. intentionally destroyed key evidence in the case, which could have led to the killer. The destruction of this evidence is further supported by how it was done, when it was done and how it was reported. The fact that additional hard copy records were not requested (while they were available) from the cellphone company, Cisco and Google further support this. Expert witnesses were not allowed to testify, while other witnesses were allowed to perjure themselves.

      For a complete and accurate assessment of this case, one needs to view the clips from the entire trial and review key documents in the case. An innocent man has lost his wife, custody of his two children and has been sentenced to life in prison with no parole for a crime he did not commit. Brad Cooper needs assistance in getting his request for an appeal approved. The town of Cary, NC may have succeeded in convicting someone for this crime, but justice has not been served. The victim's husband has been falsely convicted, while the true killer remains at large.

        Terrible misjustice for Brad.

        A bunch of busy bodies pointed their fingers at the "obvious" suspect, and the Cary Police never looked back.

        They destroyed all information in Nancy's cell phone.

        And for good measure, they destroyed her SIM card as well.

        They also left Brad's computer wide open for intrusions, so it's small wonder that an expert testified that it was tampered with.

        Too bad the judge wouldn't allow him to testify.

        And it's that computer that convicted him!

          I watched this entire trial and have rewatched the majority of it several times. How he was found quilty is nothing more than a biased judge allowing non-evidence in as evidence and not allowing real evidence like the computer expert.

          Take a look at Judge Gessner's record and see how many verdicts have been overturned on appeal.

            This trial is just as bad or even worse than the Duke LaCrosse debacle. I can only hope that the national viewers of this trial will be as outraged as I am over the handling of evidence and lack of investigation into Nancy Cooper's murder. I followed this poor mothers disappearance the day it happened and every day of the trial. I sat in court on several occasions and was appalled at the three ring circus that performed in court in front of my eyes.

            The Cary Police Dept will never answer how Brad spoofed the 6:40 am landline call from his wife, there was no proof it was rigged. There was no router in his home capable of the call. The States forensic expert testified Brad Coopers laptop was not used. Cisco Networks verified none of their servers were used at the time of that landline call. The Cary Police Dept knows the tire tracks leading from Nancy Coopers body did not match any of the Cooper's BMWs. The Cary Police Dept to my knowledge has ever heard from the "woman" that 16 witnesses saw running the morning Nancy Cooper disappeared, no woman has come forward to state it was her. The Cary Police Dept knows there are footprints around Nancy Coopers head, yet the CCBI agent Christopher Hill stated the prints were too muddy to be casted, measured. The Cary Police Dept erased two of Nancy Coopers cellphones and hid the fact 9 months+ after Defense notified them to preserve the phones. The Cary Police Dept failed to preserve and follow forensic protocols in securing Brad Coopers laptop. The Cary Police Dept did not validate the incriminating Google Search, no records were subpoenaed from Google or Cisco Networks. Why not? The Cary Police Dept was met by a bunch of pitchfork and flame throwing neighbors in Brad Coopers front yard the day his wife was reported missing. These neighbors actions ultimately convinced the Cary Police Dept that Brad Cooper killed his wife with no actual proof.

            It astounds me the DA in Wake County was able to indict Brad Cooper on tainted, non-validated computer evidence of a 41 second search of a dated satellite view of an undeveloped cul de sac where his wife was eventually found. The cookie on his laptop for this search was missing, the timestamps were altered, there are watermark issues with the Google search. It took the Cary Police Dept weeks to hash the harddrive while it sat in a room somewhere within the Cary Police Dept headquarters.

            I could go on and on about this trial. I saw nothing in this trial that convinced me that Brad Cooper murdered his wife. Thank you for bringing this story to a national audience. I'm embarrassed for the State of NC and the public servants in Wake County, NC.

              I can tell from the show's trailer that Dateline is going to shaft Brad Cooper just like the Cary Police Department, Judge Paul Gessner, and the Wake County DA's office did. AMERICA: I watched the trial as it happened! It was the most disgusting thing I've ever witnessed in our legal system. If you didn't see the trial, you should go back and watch it on WRAL.com (I think a lot of it is actually posted on youtube now too). You would not believe how incompetent the Cary Police Department was in this investigation!!!! Brad Cooper did NOT receive a fair trial. Paul Gessner should be disbarred, and the jury should be absolutely ashamed of themselves. I don't know how any of the people on the prosecutions side, INCLUDING PAUL GESSNER AND ALL OF THE CARY POLICE DEPARTMENT DETECTIVES ON THIS CASE, sleep at night. Our legal system is a scary, scary thing! DATELINE: Please don't screw Brad Cooper over! Those mentioned above have already done it, and completely ruined this man's life with NO EVIDENCE!!! NONE!!!!

                Colleen and her family should be prosecuted for kidnapping. They are evil people. To deny a parent from their child is the most base of evils. I really hope he gets custody and that Colleen is denied any visitation in the future. There are so many evil selfish people out there. It's scary.

                   What I dont inderstand is how can this utah couple raise the child knowing full well that the media coverage both local and national will be available for the child to view in the future. I'm sorry but if I was adopted and I found out that my parents duped my real father into the adoption, then he took them to court when I was a baby to get me back. I would ask them why they didn't return me to my father? And guess what evil will come to these people the little girls life will be destroyed and so will the young mans life. The selfish ignorant pigs in Utah will have this blow up in there face one day. I hope that the young man can hold on to make sure he is there for his daughter.I pray for him and I pray the lord will tell the utah couple to do the right thing and give this mans daughter back. One day we will all have to pay for our sins, And I would not want to be the couple in Utah or there lawyer on that day.

                    Utah has legalized kidnapping. It is unfortunate that the rights of single fathers are being violated to satisfy the family views of the State, which allows a statute to be exploited by savvy lawyers. I live in a State where mothers have to fight for child support, driver's licenses have to be suspended and warrants have to be issued to get biological fathers to respond. These fathers are being denied their right to due process to prove whether they are fit parents or not. A phone call or a text message should not be viewed as sufficient notice, especially when it is clear that the mothers purposely withhold crucial information from the fathers. Just because the adoptive parents are financially stable does not mean that they will be good parents. The fact that the adoptive parents are willing to take away a child from a paternal parent who wants to keep his child and whose rights are clearly being violated, makes me question their integrity. Who interests are they really looking to protect "the child's" or in their desire to have a child, are they willing to adopt one at any cost? The family laws in Utah infringe on the rights of single fathers and they need to be reformed.

                      What I do not understand is that this poor father filed the correct paper work in the state of Virginia. Utah law should honor this and the father's actions, especially since he was so timely. He CLEARLY did not have ANY written notice that he had 20 days to file in Utah. How can this be legal when "consent" can be in the form of a text message? This is absurd! A birth father who has tried to track down his child since the moment she was born should be proof enough that he made EVERY attempt to be a parent. Utah law, the adoptive parents, and the birth mother should be ashamed of themselves. Also, not to mention, possible laws broken with the hospital. This is just the most ridiculous thing that I have every heard. The true crime committed here is kidnapping and all of the previous parties mentioned should be prosecuted. The victims are the child and the birth father. This is just such an outrage! The law makers keep saying "he missed the deadline," too-bad-so-sad, and they are hiding behind a man-made phony piece of bull@!$%# legislation. I truly hope that this makes it to the Supreme Court. I will pray for the Lord's intervention to fight the demons behind this situation.

                        This is a terrible injustice for this father who did not relinquish his rights. On the contrary he has done everything he knows to keep HIS CHILD! I believe there needs to be National adoption laws which are clear and consistent in this nation so there is no question of how or what documents must be filed which would prevent this kind of pain and financial burden on struggling family's just trying to keep their own child. We treat these laws as if we are operating from different countries instead of the USA! Just do the right thing people it's not difficult, this father wants to raise his child!                           As Americans, we need to stop the state of Utah, and its theocracy from engaging in soliciting fraud and kidnapping. This state law only to serve to promote their religious beliefs that unwed parents are "not fit". The law of Virginia should be recognized and the Utah Attorney General is basically enforcing laws in his state that are as morally corrupt as the Jim Crow laws of yesteryear. Write to your Congressman/woman and let's get the Federal Government involved here. No state has this right. What is the difference between Utah taking this action and a foreign country not letting a child go that has been spirited off by one parent? The difference is, Utah is taking a moral imperative stand....the unwed parent part. This is where religious beliefs interfere in the actions of the government.

                            I am worried about what more these Utah adoptive parents will do to the child in the future. As the child gets older they will have to tell her some story about "your dad was a bad guy", because they are certainly not going to tell her the truth "we stole you and continued to keep you, eventhough your young father tried to the best of his ability to get to you, he so wanted to hold his baby and love and cherish you because you are his child, he thought he was going to see you on the day that you were born, but we snuck you out the back door of the hospital so he could not see you, we did this because we are are ugly, evil, dangerous- minded, corrupt, selfish, dishonest and untrustworthy devils, who will do "ANYTHING" to get what we want "NO MATTER WHAT". We don't care that your bio-dad loves and wants you and has wanted you from day one. We don't care to let him touch your little hand or hold you. When she learns and is able to process the truth (maybe in the teen years). Feelings of "RESENTMENT" will definitely occur over time when she learns of how her bio-dad has been trying to see her and get her back and that he never gave permission for her to be adopted.....oh how special she may feel, knowing that he has cared so much, never gave up, and has held her so close to him in his heart....Wow....she may never want to leave his side knowing the truth. That is why I'm worried for the child's safety now. What will they do so that she will never find out the truth? Because resentment is accompanied by anger, disgust, and many "why" questions. For any "so-called" friends of these people you all better "watch your back" because they have shown that they will do anything to get what they want and feel nothing about it. Once again, how can they sleep knowing that they have a baby whose parent did not give permission for us to adopt his kid. They are certainly instilling in her to steal and be dishonest as long as you get what "you" want. We all try to teach our kids "don't take something that doesn't belong to you" and we ask them to be clear "did they say you could have that?" we are teaching them to make sure that the person agreed and gave you permission to have that which you wanted.

                                  I thought Kate Snow did quite a respectable job with the Dateline report last night, EXCEPT, I cannot believe she had the perfect opportunity to pin that attorney general to the wall, and she totally let him off the hook. Earlier in the program, she said that under Utah law, even if the adoption is the result of fraud, the adoption still stands and the only redress would be for the biological father (or mother, as the case may be) to sue for monetary damages. I could not believe that when she was interviewing the attorney general that she did not ask him the singular most obvious and important question she possibly could have asked: “How could you sit there with that holier than thou attitude repeatedly emphasizing how important the law is, and how important it is not to deviate from its standards under any circumstances, and how comfortable the people of Utah are with this law, WHEN one of the foundations enabling enforcement of this statute is a crime anywhere in the world, fraud? How can any citizens professing to be so law biding be comfortable with that?”

                                    I completely agree. She also should have asked how fathers are supposed to be able to adhere to Utah's laws based on cryptic messages alone and with such an absurdly short time limit. How is some father in another state supposed to know his rights may be irrevocably terminated when "notice" consists solely of a text message indicating the mother is in Utah and contacting an adoption agency there? That's notice? All the examples of notice given on the program were about the same.

                                    And even if the father does figure it out, how is supposed to, in a mere 20 days, find a lawyer in Utah or fly there himself, especially if he lacks funds to do so? This is legally ordained kidapping and subterfuge, nothing more.

                                      America they have chosen that there laws supersedes any one
                                      persons rights because they are not important enough and they do not matter nor
                                      does the state they live in, so if your a rich Lord in new England
                                      A.K.A Utah you can take what you want when you want including a
                                      baby from a poor family in another state and the the crown of Utah will support
                                      this as a moral and legal action.

                                      like a sapaena a paper that clearly informs him of there laws and his rights in
                                      law like a victims gets. the only explaination is the law makers in Utah are
                                      trying to legaly steal a babies and sercomvent the fathers rights from around
                                      the country and hide behind there state laws that they makeup as they go.

                                      20 day notice Really!! Why 20 Days? Why when just about any
                                      other legal motion requires a notification of 30 + days what they are trying to
                                      get away with.

                                          I just watched the rebroadcast of "A Father's Fight" in December of 2011. I'm appalled with the Utah Supreme Court's ruling against John Wyatt.

                                          The "adoption" was rife with fraud, from the use of a text message as legal notification of the adoption process to the usage of the name of an employee of the adoption agency instead of the baby's mother when she was admitted to deliver the baby.

                                          The state of Utah needs to get its act together. It needs to keep its adoption agencies from conducting business like a dodgy debt collector. Disgusting. I hope John Wyatt and his daughter get justice.
